Cancellation and return policy
§ 1. Conclusion of contract / cancellation policy Due to the legal right of revocation of the customer comes through the order and their acceptance by the Africa Marcont Tissus initially a pending effective contractual relationship. The customer can revoke his contractual statement within 14 days without giving reasons in writing (for example letter, fax, e-mail) or by returning the purchased item. The period begins with receipt of the cancellation policy in writing, but not before receipt of the goods at the customer. In order to maintain the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. § 2 Withdrawals In the case of an effective cancellation, the services received on both sides, including the costs of delivery, shall be returned and, if applicable, any benefits (such as interest) drawn by us shall be surrendered. If you cannot give us back the service received in whole or in part or only in a deteriorated condition, you may have to pay us compensation. This does not apply to the surrender of goods if the deterioration of the item can only be attributed to its examination, as it would have been possible for you in a retail store. We can refuse to repay you until we have received the goods back or until you have provided proof that the goods have been sent back. You must immediately return the goods to us or, at the latest, within fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is respected if you send the goods before the expiry of the period of fourteen days. For a deterioration caused by the intended use of the thing you do not have to pay any compensation. Dispatch able goods are returned at our expense and risk. If it is not possible to return the goods due to their weight or bulkiness as parcel or parcel, it is sufficient if the customer within the 14-day period sends a written request for repossession to Africa Marcont Tissus from receipt of the goods.
§ 3. Warranty Africa Marcont Tissus warrants that the Products are free from defects in title and title at the time of transfer of risk in accordance with § 434, 435 BGB. Excluded from this are articles that have been specifically pointed out. If delivered goods have obvious material or manufacturing defects, including transport damage, the customer is requested to reclaim such errors as soon as possible to the Africa Marcont Tissus. However, the omission of this complaint has no consequences for your statutory claims. Incidentally, the statutory provisions according to §§ 434 ff., 475 Abs. 1 BGB apply. The warranty period is two years. It begins with the arrival of the goods at the customer.
In the case of a defect, the customer may demand, according to § 439 BGB, the elimination of the defect or the delivery of a defect-free product. Africa Marcont Tissus may refuse, within the framework of section 439, the type of subsequent performance chosen by the buyer, if it is only possible with disproportionate costs. If, within the framework of a repair, the elimination of a defect does not succeed on the second attempt, then the customer is entitled within the framework of § 439 BGB to demand the delivery of a defect-free item or to reduce the purchase price or to withdraw from the contract. Withdrawal is excluded if the defect is minor and irrelevant. For the rest, § 437 BGB applies. With regard to any claims for damages due to defects of the items, the statutory provisions apply. A prerequisite for the warranty claims is that the defect was not caused by improper use or overcharging. If a defect appears later than 6 months after handover, the customer has to prove that the item was defective at the time of the transfer of risk.
